According to NYS DMV, by the end of 2008, there were more than 600,000 licensed motorcyclists in New York State. That's a lot of helmets forced onto people. That's a lot of people who could overturn the mandatory helmet law, if only New York bikers would get together and attack it.

Of the 5430 reported motorcycle accidents, at least 4285 and as many as 4902 wore helmets. (over 90%)
Of the 4733 reported injuries from motorcycle accidents, at least 3787 and as many as 4189 wore helmets. (approximately 89%)
Of the 182 motorcycle fatalities, at least 139 wore helmets.
Of the 1053 serious injuries, at least 863 wore helmets.
Of the 1444 moderate injuries, at least 1160 wore helmets.
Of the 2054 minor injuries, at least 1625 wore helmets.
POOR RECORD KEEPING
It is not known whether helmets were worn in 528 accidents.
Since NY has a mandatory helmet law, it is expected that nearly 100% of motorcyclists on public roads wore helmets, so data pertaining to 617 accidents reported as “No Helmet Used” is not explained and should be thrown out, since this is probably due to ATV or off-road motorcycling.

HOW DOES NYS ACCOUNT FOR ADDING ACCIDENT DATA FOR NO HELMET USE SINCE THE NUMBER OF MOTORCYCLISTS WEARING HELMETS ON PUBLIC ROADS IS CLOSER TO 100% ?
Has NY skewed data collection by adding ATV and off-road recreational motorcycles?
The last time NY reported pertinent helmet safety data by separately reporting head and neck injuries was forty years ago. The NY State Highway Patrol filed a report of a study with the NTSB that in the first year of their mandatory helmet law (comparing 1966 to 1967 data), NY had a 75% increase in severe neck injuries. http://www.ntsb.gov/Recs/letters/1973/H73_30.pdf
